Default Got fine, 60 days til opens *help*

I just got a fine of $350 and 6 points.I'm 60 days off getting my opens. I've heard of people close to having their opens waiting til the get a reminder notice then say they want to appeal it in court to stretch out the time. then before they go to court they pay the fine so the points come off their opens. Both of these people were from N.S.W. I was just wondering if this will work in Q.L.D? it's either try that or go on a work licence for 12months. Any help will be appreciated

i dont think you''ll have much of a chance.....you did the crime on your probationary, you should wear that kind of punishment IMO

Double demerits only applies to seat belts and speeding.

I'm pretty sure he was speeding.

Send them a letter which will extend it a little, and I think you have something like 21 days to pay it after you receive your 2nd notice which will arrive about a week after the due date period.

The penalty starts for the time you are convicted or pay the TON. If you pay the fine within the prescribed 21 days you will be walking.
Should you choose to contest the alleged offence you will have to appear in court. This will be more than 60 days as Hervery Bay MgtCt is fairly busy at the moment. This is assuming the offence was local.
What were you booked for? Where did it happen? Did you actually do it?
See a solicitor tomorrow. There are a few who specialise in these matters.
If you did, in fact, do it, here or in Maryboring remember the traffic branch is small and they have good memories so if you manage to keep your licence PULL YOUR HEAD IN or you will get rolled again....

I was booked for 131km/h in a 100 zone, on hervey bay burrums road and i was around that speed not to sure (i was overtaking down a hill) It's my first fine. I was under the impression that 130+ is loss of licence anyway, or is that state specific as well?

you don't get suspended in queensland but if your over by 40kmh a $700 + 8points and 6mths suspension

That's about the average speed I do when overtaking, I don't like to spend any more time on the wrong side of the road than I have to.

Same here. get out and get back. I am sure if you tell this to the boys in blue then they can make a disretionary call. I did it once but unfortunatly I was miles in front of the bloke I overtook....

Well for starters you were going down a hill. From memory there is a law that states that you can't be booked within a certain distance of an incline or decline. i know of several people that have gotten off low level offences in Melbourne's tunnels because of this.

You must have been doing well over 131 then. The speed you are fined for is after the allowance for error has been removed. In VIC it's 3 kph (used to be 10% + 3). I assume it varies from state to state but if the old VIC rule applied your actual speed would have been around 147 kph. Assuming you have an error on your speedo (mine is a constant +4 according to the GPS system), your speedo would have read around 150 kph.

Isn't it amazing how many people get done just 1 Klm over so that it puts you into the next bracket of fines!!
Reminds me of a few years ago while working in Newcastle. Two of us driving the same type of vehicle went through the same fixed camera (40K's) at different times and both clocked 51Klms. Amazing!!!
Then went to Wyong and my mate got hit again for 51K's in a 40 zone.

This was a "loop-hole" most States fixed some time ago.

I held out on a fine until I got the second "pay or else" notice. Paid it and held on to my licence.
(I was done for two points and only had one left, by the time I paid the fine, I had got two lots of two points back)

I know of a young bloke that tried it about 12 months ago.
It was "backdated" to when he was stuck with one point... and he lost his licence for three months.

Here in s.a the exact same thing happened to me except it was for a u turn at a no right turn sign it took them 6 months to get me into court and i had got my full license 5 months earlier but they said if i lose in court its back to p's straight away remove the points of the licence i had at the time then id have to go bak to p1. Lucky i won in court lmao now im fully licenced.

I'd assume you got done for speeding, I don't think there's any other driving infringement you can get up here that belts you for that many points.

The thread starter is located in QLD, not NSW guys...

Last time I went I was doing the stated 39 over , and didn't pay , then appealed etc and now I am back on full points , it cost me $350 eventually in time to pay but I got more satisfaction than that in return , road works on a sunday marked from 80 down to 40 signs covered but hats still on roads edge ... someimte you have to just be difficult , call that link suggested as you might be able to drag it down on speed and save points/ good luck

yep. i think it depends on how you handle the situation and whether the cop that pulls you over has had a good day or not. i once got pulled over for 91k in what used to be an 80k zone, but was marked down to 60k for road works on heathcote road. i told the copper that i honestly didn't realize that the speed limit had been marked down, he dropped the fine down a bracket: between 15 and 30k over. i thought that was good of him.

Depends on the actual degree of incline/decline ... there's a fixed speed camera on a hill at Kurrajong Heights, NSW.

No matter how much engine braking you do ... you still need to brake through it to maintain the speed limit.
