Burnouts on Private Property

Went to my mates place for a few beers with the boys on Saturday night, sitting around the fire drum in the garage talking crap and listening to some tunes. All going well til paid a visit by the cops. Apparently doing a burnout in a 350 HQ coupe (with 3" twin system) in the carport, behind closed gates at 10pm is frowned upon by the local constabulary. Anyway, all panned out ok after a lengthy discussion (including admission of being under influence) but 2nd warning to my mate. When asked what happened by the police, my mate stated he had a few beers and gave the car a rev, to which they replied "What's the black stuff all over the concrete?" which he promptly stated "Rev dust" whilst holding back the laughs. Anyway, really just hoping to clarify the rules and regulations on this, as there are conflicitng thoughts on the subject Eg. that the police cannot enter closed gates without consent etc. I know its a silly and potentially dangerous thing to do, and said mate isn't proud of his actions.

Cops can enter property if they suspect a crime is being committed. At the very least, small-block burnouts would contravene noise regulations.

and you can and will get done for drink driving doing it as well if they feel the need to charge you for it... don't think because your inside some gates your safe, because you are not..

That was my understanding too, I thought that he'd definately get put on the breathalyser, fortunately he was co-operative and didn't go blasting his mouth with the misinformation everybody else was telling (eg. "tell them they have no right to come in" etc). Admitted he was at fault and that it was a dumb idea, and explained that his job depends on having his licence. They were firm but fair with the warning, and at least had some appreciation about modified cars.

Ah the memories... One 454 WB ute and a carport combined with a few beers :-)

And circle work around the clothesline on wet grass on a road race tyred supermoto bike, LOL.

My friends hide the keys these days when they see the look start to come across my face :-)

Apart from the noise issues, dont think they can do much. If i recall, Drag Tag had burnout comps on their private land. They could of had permission though. Also, have read of private compounds where these have been held.

i think the noise would be the problem, not the turning of tyres itself..

am interested to find out what the law is regarding drink driving on private property. you dont need registered cars on private property after all..

been there done that, trust me you can get done for DD on private property..

epa rules apply . excessive rules plus noise and maybe drink ? and dangerous drive.. ouch that would cost...

Spot on atec77 It is the EPA law relating to Residential noise, Police have the power to also issue an on the spot fine for excessive noise, however they generally will issue a direction and if they have to come out again you may get a fine.

as for burnouts... you can't even FART without the cops being upset about it nowadays

If you gave the police a hard time they would have done the bloke for DD the revdust was probably a good call making everyone laugh
a burnout 10 at night in the suburbs is drawing the crabs especially when you dont leave the scene.
Theres cops up here who tell people to turn their stereos down after noise complaints they come back 15 minutes later if the musics on they confiscate the stereo

If you are in suburbia the biggest one they get you on is the noise. Out in the country we can make a bit more noise! I have a friend who was chucking a massive skid in his shed. Someone called the fire brigade thinking there was a fire inside. We all got a good laugh out of that one.

Legal advice on internet forums is worth exactly what you pay for it, nothing. If you want to know your rights then go see a lawyer and pay him a couple hundred bucks and get the truth.

Having said that the police can no just come in to your property. They can go on the land and up to your front door or gate and that's it. If they ask permission or try to enter without permission then politely refuse. No need to be nasty, just stay polite and say, "no you can't come in".

If they push the issue, find out which station they're from and ring that station and ask for the local area commander and tell them that you don't give permission.

Don't talk to the cops more than you need to.

Yep, I beleive I made that point.

Doing something blantly illegal IE: drinking and driving is going to incur the wrath of the law but at the end of the day the law needs proof too. Don't do stupid and possibly illegal where it can be seen from the roadside.

Interesting thread.

Noise issue aside, can you be 'booked' under the hoon laws / exceed .05 on private property as some have suggested?

I've been to a few barbies where we've ended up pulling some skids for the boys on the property owners land, and to be honest everyone has been under the impression that (aside from noise and smoke) we are safe......................................

See - you get drunk, have your mates around, silly stuff happens, someone gets drunk and makes a mistake, someone dies.....trust me, the cops will find out who is criminally responsible.

If the offence is classified as indictable, its even worse. If people are going to get drunk and play with cars its my hope that the police DO get involved............

Cant turn back time and unwind a horrible mistake.........prevention is best cure.

In Victoria most offences covered under the Road Safety Act 1986, Road Rules General Regs, Road Rules Vehicle Regs and Road Rules Drivers Regs only apply to a highway, which includes roads and road related places. But two offences come to mind that can be anywhere and they are drive manner dangerous and drive speed dangerous. There may be some others. The EPA will surely cover the noise and some common law powers such as breach of the peace would empower police to act.

I would never admit to anything and really at the end of the day how can you be done for anything if the cop himself did not witness it/hear it? Imagine how well that would stand up in court, no actual proof or anything. If they catch you red handed then fair enough cop it sweet, but if they arrive after you have done the deed I think your safe. when one of my cars was unregistered getting ready for a new paint job I took it up the street and back and gave it a small squirt (not even 2 mins of driving), some fairy rang the cops and one arrives 15 minutes later. the car is stationary up the driveway doing nothing. He asks if I've driven it up the street, I reply no. He goes up and feels the bonnet is a tad warm and asks why is that, I simply reply I started it up to charge the battery. He proceeds to ramble some crap about being careful and IF I was doing anything its not a good idea. I reply yeah no worries, he heads off and Im free. No proof = no case, simple.

Glad to read so many have totally forgotten their inherited rights. Even police with warrants, and who enter on that basis, 'can' face trouble, but that typically means a high court visit.
