i was driving home and passed a cop
just around the conner from home about 100 meters he flashed his lights and try to pull me over and i just pulled into to the drive way he pulled up behind me and said come here and bring your licence then started writing me an infringement notice and said i failed to stop the fine cost me $450 |

As far as I know, as you were in private property, he can't do anything. Especially if he only flashed you just before you turned into the driveway.

when you say flashed you? do you mean via speed detection device? or just with his High beams?

Surely common sense says it's easier to just pull into your driveway and shut off the car, then deal with him.

a similar thing happenied to my mum, they had a random breath test set up just past our street turn off, and once mum went home down our street, parked the car and went inside.
about 30 seconds later there was sirens blaring and cops flying down our street about 15 minutes later (after thet finally found the car) there was a knock at the door and the cops were asking all kinds of questions but mum refused to answer any because she knew that they couldnt do anything because she was on private property etc.. so they left your situation would depend on how far from your house you were and if you did anything wrong to entice the cops onto you.............

Mate regardless of how close you are to home, you dont keep driving away from a copy with the disco lights on! Best of luck fighting that one cos as far as Im concerned youre completely in the wrong. You didnt stop when instructed, end of story.
Steffo - they can pull you up pretty much anywhere, doesnt matter if youre in your own driveway or not.

no they cant touch u on ur property unless ur are blatently doing somthing illeagle, if this case, however, if u were 10 meters from ur house u still have to stop on the SIDE of the road, because he flashed the lights at u, u must stop. simple as that, if they didnt flash u and u pulled into ur property then they cant do anything. because the car is on a private property, if the cops could pull up people in thier own drivway every one with an unrego and unrwc car would be so screwed! but yes is this case u are in the wrong unfortunatly. so just pay the fine and save the leagle costs

Private property means jack sh*t the offence was committed on a public road...your gone.
To the other side of the coin you chuck donuts,circle work on your own property..they can't touch you.

what did you do to make him put his lights on? you must have done something..
i drive past cop cars all the time (as would almost everyone on here!) and they dont put their lights and sirens on and try to pull me over all the time?? you said you were around the corner from home when he flashed the lights at you?..... you cant just decide stuff it ill drive the rest of teh way home! |

Was it only for not stopping that you got fined? Or was there another offence added on, which you were originally being pulled over for?

I know common sense should prevail, but 100m in a 50km/h zone with a cop car behind you with it's light n sirens on must feel like a very long ride! As for private peoperty - if i'm in a police chase and then drive into some private property, i'm PRETTY sure they can still charge me! -Stu |

Its not hard to be unsure. All you have to do in an XR is toggle between high beams and fog lights and there are some stupid people who will pull over.
My mate did it in his XR6 and while it was funny i told him not to do it. He managed to pull over a Corolla. Then did a fly by. Hes not the sharpest tool in the shed. |

guys why we are on this topic, if you get pulled over by a unmarked cop car and they dont have a rader on but had to go 150 to catch you could they charge you?????cause my friend told me this story and i laughed in his face and said he was a bs artist cause he kinda is neways wot do you ppl say real or total bs or even a pranker like in dogbreath 48 's story

He said he didn't get a radar reading but was doing 250 himself and couldn't catch him (before getting told to cool it!). I presume he planned on charging the rider with this info alone. I think tyre spikes then a baton to the back of the head is the best way to get across to people that the disco lights are not a request to stop when its convenient to for you.
You know people run and try to get to home for a variety of reasons when they get pulled over. Think about that and you will understand why the officer was miffed at you and handed you said infringment. |
