Default AUIII XR8 Auto playing up

Hi Folks.

Any suggestions as to what is going on here.

AUIII XR8 Auto.

Once put in neutral, and foot off brake, car moves foward. It is on a flat surface, actually when I witnessed this, it was on the slightest of inclines.
When transmission is cold the cars shudders like crazy when moving off, this disappears when transmission is warm.
Fluid levels okay.

It is a blow out to witness. There is a positive disengagement when placed in neutral, once the foot is off the brake, the car moves forward as if it was in drive. : :
