About 5 years ago I bought a unregistered/unlicensed 81 Fairlane that had been sitting in a front yard.
The plan was to do a quick resto and put the car back on the road as a work hack. 5 years later and after replacing nearly every panel and re doing the paint and interior I'm just about ready to take the car over the pit for roadworthy inspection. One small problem....I have no ownership papers or receipts for the car  I basically knocked on the door and asked the owner if he wanted to sell. Apparently, I had knocked on the door at the right time as the owner was about to call Simms to collect it for scrap due to a rent/property inspection. I offered $150...$50 more than the scrap price. The car had been de-registered and the plates handed back to the licencing department. Where do I stand? Anyone been in a similar situation and what did you do?  |

Maybe get a Stat Dec signed, saying when you pruchased the car.
Maybe a quick call to the RTA. |

from memory as long as its not on the stolen database, you are the rightful owner, this is going back at least 5 years ago when i was in a similar situation.

If it's NSW then the RTA (now RMS) will want a receipt to prove you purchased it.
Having said that. I was told, in a roundabout way by an RTA employee, that they don't really care who writes the receipt, just so long as they can see one

You will need a stat dec signed in W.A. My brother had the same issue about 2 years ago & was lucky that his extremely smart brother kept the guys mobile number.
If you can't get hold of the previous owner you will have to do a stat dec & they will hold it for about 30 days. If previous owner has not come forward / reported stolen etc, they will register it in your name. |
