According to Bloomberg, 705,000 owners of Silverado and Sierra HD trucks sold between 2011 and 2016 fitted with the 6.6-liter Duramax diesel engine filed a class-action lawsuit against the Detroit automaker claiming the company used multiple defeat devices to skirt emissions laws. The suit alleges GM’s defeat device allowed its trucks to pass regulatory inspections despite spitting out emissions two to five times the legal limit under regular driving conditions, a far cry from the VW diesels, which were emitting up to 40 times the nitrogen oxide pollutants allowed in the U.S.

If this somehow does go to trial and GM actually are found guilty of emissions cheating, the plaintiffs would have to show that their clients suffered a loss or damages as a result of the false advertising about the level of tailpipe emissions. And a potential loss of resale value won't cut it. That is where their case will fall over.

Just heard on news that Trump has renegged on the Paris climate change deal that 195 other countries including Oz, China and even North Korea have agreed to be part of.

They lost the purchase price as soon as they drove off the lot regardless, due to depreciation. The resale of US-made cars has always been woeful in their home market due to the relatively low purchase price as new propositions.

Pretty sure the commodore guys just remove the radiator not the engine for cam changes

That's why people can win a defamation case, and get only a $1 in compensation. But in the good ole USA, they can award Punitive damages, which as the name suggests is not based on any actual loss but is purely to punish the company. Furthermore, the damages are decided by the jury, so if you get them sympathetic and they decide to stick it GM, that's when the big bucks start rolling |
