I recall a whole big thread or maybe it was a sticky, if we used information from anywhere else or if we used a picture we HAD to acknowledge the source due to copyright or we could be in serious trouble, so how is this situation any different.

The person tried to use a picture without permission now they have been busted, just cause its on the internet does NOT make it a free for all.

The main thing is who took the photo?? I aske because the person who takes the photo has the copywrite to it and can do what they like, Now if it was not taken buy the pill guy then you have every right to tell him to remove it. If it was taken buy him you dont have a leg to stand on Sunny sorry.

No all true there, I remember an on-line phot comp recently that was run, and part of the terms and conditions was that ALL photos submitted became the property of the people running the competition to be used in any manner that they felt, and you lost all rights to the photo.

Thats why i was trying to find the so called terms and conditions on the website in regards to photos.

Ok maybe send him another email referring to the User Agreement Terms and actually put the following information in plus a referral to the fact that you are notifying EBAY his breach!!!

You could also try using the above info as he is infringing on the rights of a third party (being the owner of the vehicle being shown doing an illegal activity - yes I know it was stated it was taken on private property etc, but you want the pic gone.. then dont go admitting that!!!!!!!

Also read Number 6 (YOUR INFORMATION)... there is a few things in there you could possibly throw at him.

BUT
it comes down to a complaint being made to EBAY...... since you werent successful with the seller, that is the only option!!

not if it has been uploaded to an internet site that is a public site....
(unless that site states in their TOS that no photos, etc can be copied and used anywhere else etc)....

Does the site where the photo came from actually state that in their TOS?

There are ways around most situations though... He is selling something.. He has peeved off a member who is friends with lots of other members and may have respect of even more members of a site that boasts over 10,000 members....
Use that fact.... !!!!!

Yes it is all correct my wife works in copyright law. The person who takes the photo owns the copyright. It doesn't matter if it is posted on dozens of site's it sill boils down to who took the photo. The only reason all contests state that on there TOC is so as they may use said photos for publicity purpose's. And yes they then own the copyright because you have signed it over to them. But in this case the guy using it in his add does not have the right to do so.

then you would be able to contact the seller (or the person that it is being sold for) and request the pic be removed.....
I noticed under the video thingo that it says something about this product has been listed on behalf of ??

I still think Ebay would be the best option to have it removed personally.

john, u dont need TOC or copyright sign, u took the photo so its UR photo, complain to the seller, or get sunny to complain to ebay because it is illeagle.

It looks like this ebay seller also runs this site. Do you know anyone called Glenn?? I'd call one of those numbers and try to get the ad removed. The guy obviously thinks because someone has posted it on his site that he's free to use it.

He's getting royalties from displaying a picture he didnt get authorisation for.
As far as I'm concerned, the pictures on this site BELONG TO Fordforums.com.au.

Like with artwork, as soon as it's drawn, it automatically becomes the owners copyright property.

Sundeep has a right to take action!

I'm annoyed that he's got my number, i'm suspecting he got the numbers from ebay or something, then made some cheapo ad on his own site with the picture (still don't know how he got that) so he could use the pic.
