Drinking while driving?

Yeah one of my mates was drinking in the back of my car and we got pulled over and the copper made him tip it out, he said it was classed as drinking in a public place...

I have heard something similar... it's only illegal if the keys are in the ignition. This means the keys could be in your pocket. I don't know how accurate this is but I can see the sense behind it because if you really have no intension of driving why put the keys in the ignition.

Same, i would of done it 90% of the weekends for the past 2 years, never had trouble being pulled over with cops, dont usually promote the fact im drinking though and try hide the open or just skull when we got pulled over lol, diffrence is i have known its illeagal. Ahhh good times being young!!!

Even if I had of know it was legal I wouldn't care. Be ****** if I'm following that rule as it is a very stupid one at that. Spose if you put the lid on it then it's no longer open. Bit hard for tinnies though, so skull sounds good :

Not if the keys are on you , Only if they are in the ignition. Why would cops wake you up and search you if you were minding your own business ??? Back on topic, Years ago my fiancee at the time was driving me home from work, i had a roadie- and was drinking right beside them ! Didnt even see them . We were pulled over & i had over $1600 in warrants. Spent 2 weeks in watch house before she could raise the rest for bail. Moral? i still drink when passenger ,(my wife doesn,t drink at all) I am a lot more careful about it , I now pay my fines on time ! Thank you , my names Darren & i,m an Alcoholic ........ :togo:

Taxis let us do it all the time. I've heard its illegal and the driver is the one that gets pinged...but if the taxis let us do it then maybe its just a rumour spread from across the state. :

Completely true. Technically he's in control of the vehicle.

I had a mate that we would help into his car and would roll a tyre over his key and he'd lock himself in the car and go to sleep. Unsure what would have happened if the cops had come a knocking though. Probably not a good idea if you have a key fob either. :P

It's illegal to have the keys within reach or even in the ignition (to keep the a/c, radio or whatever on) while you sleep off your drinks.
If you can fold down your rear seats and throw the keys in the boot, do that, or lock them in the glove box and put the glovebox key somewhere else?
My friend and her seargent booked someone for doing that the other night, though I think he also had sun shades up to the windows, binoculars and a couple of magazines..

You can also be done for talking on your mobile even if you have pulled over and switched the car off, but are sitting in the driver's seat with the keys in the ignition.
They've said the best thing to do is get into the passenger seat, or throw the keys into the back.

Definetly in WA classed as street drinking, $200 infringement on the spot, expensive roady.
