I am surprised you are still allowed to smoke and drive. I know you are not allowed to smoke while driving with minors in the car.

I came to live in Victoria in 2003, and often spotted people sitting at the lights sucking back a VB etc. To my surprise I found it was legal, it was around 2011 when they closed that loophole and made it illegal.
Still plenty doing it though, I often see people popping into Dan Murphy's to purchase 1 cold can..

I've done it before as well, stopped into a bottle shop and grabbed a 6 pack out of the fridge had a solitary coldie on the way home and the rest at home.

You still see people doing it now, you see it pretty commonly on the Tullamarine Freeway around knock off time for the tradies, I guess people weren't aware of the rule change.

Or it could be like smoking, Melbourne has no smoking areas everywhere but people still smoke in them and no one really cares.

You would like Rockdale in Sydney then, Its compulsory to smoke at the outdoor cafe's there. Russian mafia don't seem to worried.

I've never smoked in my life and smokers don't even bother me, I'll sit among them in an alfresco area having dinner with them, or follow them out to continue conversation as they smoke away from the crowd, its always ex smokers with the problem with current smokers.

So out of curiosity, why is it illegal:

* for passenger(s) to drink alcohol in the car, provided the driver is under the legal blood alcohol limit?

* for the driver to consume alcohol while driving, provided they are under the legal blood alcohol limit?

a) Can you drink out of a can, stubby or long neck without taking yours eyes off the road; or do you drink your beer with a straw?

b) Another reason it slows down road side and random breath tests as the have to wait quite a while for the body to get rid of alcohol fumes from the mouth and throat.

c) People also used to use it as a way to get off DUI charges by sculling some beers after they had been pulled over.

Out in north west NSW when I was growing up that was just for a quick trip to the shops.

Even the Cops had an esky when doing their rounds.

Just remember that alcohol affects every body in different ways.
It even affects the same person differently depending how tired they are when they last ate etc..

From what I've witnessed over the years one beer or one glass of wine can affect some peoples judgement so much they shouldn't open their mouth let alone drive. this is despite being within the legal blood alcohol limit.

anyway I predict in the future we will have a 0 limit. its a cultural change if you going to drive at all don't drink.

passenger is fine IMO but that may change too.

Way back in '97, I did a security course and was told of an incident where a person dropped one in a lift, and when the lift opened and a victim walked out, the culprit laughed, and the victim had them charged with assault.

Not sure what the outcome was, but it's a example of a deliberate application of force.

At least in a car you can open windows, unless the window "lock" button is applied.
