I need a rear window with demister and seals which will very probably be easier to get windscreens obrien to fit (they gave me a discount) , right tail light, drivers side mirror (including the entire surround) and front bar. Would be great if I could get a new bonnet and boot but I'll get those repaired as they're minor and they can attempt to colour match them to as close to possible.

If he has a console lid that's not damaged I'll kiss his feet!! :

Be strong, restrained in anger (think calm!), and rational. Get this bastard, get the courts to bend him over and :

Thoughts are with you guys xxx

Long story short, basically nothing. What I understand is that we need to make a seperate application for compensation, which is not what the tenants union told us. We did what the tenants union told us we had to do, which was apply for renewal of the proceedings we had already started, and include with that application a written report of the items that are missing and we are claiming compensation for.

Turns out that we need to apply for compensation seperately, and despite the landlord admitting he STILL hasn't done what he has been ordered to do by the court several times now - submit the bond to the bond authority - the judge still did nothing asides from get angry with him and yell a few times.

One interesting fact turned up during the hearing - the landlord (well, his son, to be more exact) knew about the damage to the car.

Re-read that last sentance if you like, there are no typos in it - they knew about it, and admitted they knew all about it in court. Yet when asked why HE didn't report it to the police, he responded "Because I don't care, to me, it's shit, it's not mine, why do I care?"

Is it just me, or does anybody else find that rather suspicious?

So tomorrow we submit our application for compensation.

Not much else to write really. We are NOT happy, as I'm sure you can all understand.

Well them saying this infront of a judge, lawyers etc. Must help you. You have plenty of people, who heard this.

They are just digging a much larger hole.

Good Luck Guys.

Dazed, confused... what the hell happened today?

Can someone hit rewind for me?

How the hell does he get away with this?, Even admitting that he knew of the car damage, however he never called the police, that's my job even though I didn't know about it until late last Saturday evening?!?!

The police say it's a civil matter, VCAT say it's a police matter.. what the f*ck??

xrgran I think that the only way that I am going to resolve any of this fiasco and cr@p is to start with the local media, I MIGHT get some bloody answers that way! ACA haven't made any attempts to get in touch with me, maybe I should try Today Tonight... *shudders at the thought of either*

He talked to our neighbour Jeff who told him that we hadn't been there in weeks, we didn't have any neighbours called Jeff damnit!! And there was a car parked in the driveway, a dog in the yard, lights were turned on and off to give the appearance that someone was still in the house and he claims that we abandoned everything.

Then he goes on to say that all I had to do was to give him a call and ask him to open the house and he would have done it. He said no to the cops, what the hell was he going to say to me?

I don't give a shit what anyone says the whole friggen system or VCAT in particular are only there to protect landlords, including @rseholes.

I mean for FFS he said I was behind in the rent, he had no receipts, I had all mine that proved I was up to date and the arbitrator still took his side.

This is so f#cked up!!!

Tomorrow I am going to start one hell of a compensation case on him, contact my lawyer and I'm going to prepare to start dragging his **** through the Magistrates court.

He was a little surprised that the car had been taken and all the stuff in the house has been removed. "What do you mean you took the gates off?".

Stupid f*ck knuckle!

If I ever felt the urge to kill it was today.. okay now yesterday and today.

pfft! I wish I was joking.

Don't worry I haven't been to sleep yet, I've been up all night working on my compensation claim (trusty old diet raspberry and apple cordial kept me going).

I'll get this claim in so fast his head will be spinning. There's only so many bullets he can dodge and he wont be dodging this one. I don't care I have to chase him for the rest of my life! He'll see what a piece of shit the EB is when I run him over with it. :hihi:

Yeah you better run egg!!

Please excuse my sleep deprivation induced psychosis. :

Better go and call Windscreens O'Brien and get the back window put in. Hey I can add telephone calls to my costs. :

How about phoning 'John Laws' radio...he LOVES gritty stories like this one or else Stan Szumanic (spell?) or Alan Jones.

Anything is worth a try at this point in time.

Can I ask what happened in the beginning to make the landlord such a *****?

It might be time just to take the loss and move on. It doesnt look like anyone is out to help you.

Do you still have the new engine ready to go? Has fitting it been organised yet?

Of course you can ask, I thought that one or the other of us had already answered this question, but I'm not sure, and I CBF reading through all 16 pages of this thread.

So, long story short, around christmas he decided he wanted to sell the house, and wanted us out in a month, when the lease didn't expire until half way through this year.

When we didn't leave before the new year rolled around, he completely changed, started ringing and leaving messages such as "You want trouble? I give you trouble", coming around and letting himself in, refusing to do ANY maintence on the house, bringing around real estate agents to value the house without notifying us properly of this fact beforehand, and probably a few other things that have slipped my mind.

So basically, because we didn't jump when he told us to.

We will not give up until ALL possible avenues have been pursued. Why should we have to just take it as a loss when he's done so many things wrong, and we've suffered as a direct result?

Regarding the new engine, I'm not sure what is happening there, we do still have the new engine ready to go, but I'm not sure when it's going in, I'll ask Nikki, and I'm sure she'll respond in this thread herself.

Ahh okay. I hadnt read that part before and didnt want to read it all again.

I think you should pursue getting some compensation but stop once it starts costing you more money than you will win back if you get any at all.

He sounds like a dodgy bastard but they always seem to get away with it while the innocent party's get screwed.

Im in for helping with the engine swap as long as its on a weekend.

It's not going to cost us more money than we'll win back, VCAT is free, if I do end up going to the Magistrates court then I'll be getting legal aid because I'm on a low income. Hell I've paid taxes for years and still do, I'm just going to use what I've put into the system.

That would be rather enjoyable... However I suspect if something like that was done now, we'd be the prime suspects...

It might have to wait :hihi: <- joke (for those of you who might have taken it seriously)

A 303 (gun, not engine) is accurate to the size of a human head at 1000m...

But seriously, a walther P-99 at point blank is more amusing.

(Man am I sick or what)
