Hoping someone might be able so give me some advice as what to do. I got a job last Friday (8th) and I did a days work with another person who was training me how to do the job. I did the days work and decided that the pay ($28) wasnt worth the amount of hard labor involved and I told that to my employer who then said that I won't be getting paid for the days work that I did because I was being trained and I needed to do a whole week to be paid. Is that true? And can he not pay me? I told him that I did a days work and I should get a days pay and he said fair enough and to email him my bank details and he will deposit the money on Thurday. Well he didnt and is just leading me on and wasting my time by telling me details I sent him were incorrect when they were correct and then he said there will be a $5 admin fee when he previously didnt mention this before. I told him that he didnt mention that there would be a $5 fee and he replyed with "You didnt mention you would only be working for one day".
What should I do or say to get him to pay me? Any help would be much appreciated. |

So hang on, you worked for a day, didnt like the pay so you left the job? That right. Just trying to work it out for myself as your post is a bit confusing.
If Ive got it right, I wouldnt bother. Its $28, just walk away. I'm owed a lot of money from 2 previous employers but I know I won't see a cent of it, it's just not worth it.

The employer is probably annoyed he spent the time to hire and train you (which would have meant the other employee training you would not have been working to their capacity) and you decide after this that you dont like the pay and dont want to continue. Dont get me wrong, I understand where you are coming from, but it is probably a bigger pain for him and would have been a bigger loss $$ wise to him than the $28 is to you.

Considering he was doing hard labour, how much training is involved? Not much I'd say. If you worked a whole day, you should be paid for a whole day. Sounds like rubbish you'd have to work for a week to get paid. The training "pay rate" sounds like a way to scam new employees.
At one of my jobs, I make a few bucks less per hour - the job? Dockhand for a road transport company - unskilled job that involves lifting. We don't pay new workers a training rate either.

This is illegal in Victoria. He MUST pay you according to the award or workplace agreement applicable to that job.
$28 would be 1 or 2 hours pay at most. I don't know of any award that says you don't get paid till you've worked a full week. Also the $5 "admin fee" is illegal. He cannot charge you to deposit your pay. If he is copping a bank fee or whatever that is his problem, not yours. I would contact Wageline immediately and let them sort it out for you. |

Yeah, what Kaptn said... Minimum wage is $12.75 an hour, get on to Wageline.
For $28, you could walk away and save the hassle, but I'd do it on principle.

A day's work deserves a day's pay IMO. I wouldnt bother spending too much time to chase down $28 but in the principle of the matter i'd be following it up.
Was the employment legit? i.e. you provided your tax file number, were paid super etc etc

Did you establish the $ pay rate before starting work? Like others have said it sounds like you've only worked 2 hours.. or you've accepted a job on $3.70 an hr which is an illegal pay rate anyway.....

Hang on, is it $28/hr? Then you would be owed around $200...
(NC Steve, I also sent a PM with some more practical advice.)

If he knew the pay was only $28 per day he could have said no to the job. Casual wages have allways been higher than full time employment rates to compensate for the "casual" nature of the work. 3 month on casual wages to prove your ability then onto full time wages at a slightly lower rate has been going on for decades.... its perfectly legal, and reasonable IMO, and its got NOTHING to do with the Govt.

And dont complain about the (now) $21per hour. That still works out to about $800 for a 38hr week!!

This has everything to do with the John Howard.
John Howard is short! And everyone knows short people cannot be trusted! Would you leave your wife and your car keys in the hands of a jockey? NO! Hell no! and you know why. Cause the creepy little bastard is sure to bonk your missus like pharlap in the melbourne cup and drive off in your car! They have strange and unusual habits short people. They can lie to you easily, because at their low vantage point noone expects them to look you in the eye! Crafty and deceitful. What australia needs now is tall people, to bring back honesty, love and understanding back to us. And noone is taller then that 9 foot high bald pot farmer known as Peter Garret! Once he is installed in power, its quite obvious that all our problems will be solved, especially the one from the thread starter about... whatever his problem was that I didnt read. Didnt have to! Cause whatever it was, everyone knows it was caused by a short bastard.
