Love tap gone wrong

I just want to vent my frustration at insurance companies letting fxxxwit drivers get away with being what the are.

I was in a left turning lane beside some lights waiting for the driver in front to go, he pulls off hard, I left the clutch out, have a look myself to see if its clear, it's not, so I forward look to see where the driver is in front and he has slammed on the anchors. With a loaded trailer on back, I pull up too slowly and just touched the car in front on his left hand corner.

There was no damage, we didn't even swap paint and the xr front didn't even break its two tabs and he claims I did all this damage to the right hand side. The solicitor says I have to pay $800 (reduced from $960) and a court wouldn't let me prove my innocence. I offered to pay for a new genuine Holden Nova fantastic plastic bumper but to no avail.

Just needed to vent...

Advice for the future, ALWAYS take photos of damage. even if its with a camera phone. at least that way you know exactly what you did.

if there was damage, since it sounds like your fault, then you got to accept it and move on...otherwise, since he is playing dirty your got to play dirty back...he reveresed into you didnt he?!

Bit better advise, always make sure that the car in front of you has gone before moving forward. I won't check the oncoming traffic until I am sure that the car in front has gone.

Sorry mate, but your in the wrong. You rear ended him & should have been paying a little more attention. Might sound harsh, but its true.

In the laws eyes he was in the wrong, BUT I have seen so many people purposely slam on the brake in the hope someone would go up the back of them which shits me, ecspecial in the wet or heavy traffic.

Having said that my old man about 6 months reversed into the side of a old school corolla, he put a small dint a little bigger that a 50c coin in it, he did the right thing and left a note with his number and so on.

The women who owned the corolla called and they swaped insurance information and so on. So dad paid the excess and the his car was fixed and as far as he knew so was the womens.

Anyway a month later my old man gets a letter in the mail with a bill for $2800 for work done to this corolla, lucky dad took photo's cos he called the insurance and the checked it all out and dad was in the clear.

What had happen is the women who owned the corolla new the panel beater, he fixed the head lights the tail lights and indicators and resparyed both sides of the car and tried to make it look like my old mans fault, so the insurance company took her to court, she lost and had to pay for everything and got in the sh!t for fraud!

Seeing as you ran into the back of that vehicle you are in the wrong as mentioned above ... sgt doofey made a good point ... I guess next time you just wait till they have gone ... it only takes a split second of lost concentration.

I read it as yes its his mistake but more annoyed about how much damage is claimed. Best thing about mobiles is you always have a camera with you as pointed out earlier

keep a DISPOSABLE camera in your glovebox.
phones may have cameras but the quality of the picture will never be the same. when your trying to get the absolute finest marks on film, it is better to have a proper camera.
this could be the difference between an empty wallet and a full wallet.
ALWAYS exchange names addresses etc.
also take a pic of the DRIVER and the NUMBER PLATES of the car you hit (or hit you). also some reference shots of the EXACT location.
is easier to prove a case against someone else if you have exact photographic evidence.

Cheers guys, good advice. Just peeved 'cause I can never seem to get my insurance rating down... maybe there's a common reason for that...
