Thats why i asked if a bill of sale had been provided, without it, the guy who took the AU cant prove he actually did a swap, it could have been a trial period to see if both were happy with the cars.
It would come down to his word against the other guys and if it went to court i'd put my money on the OP, especially when it is disclosed that the BF had an encumberence on it.

If the OP reported it stolen, the guy who took it would have to prove that he aquired it legally, and the only legal proof of ownership of a car is a bill of sale.
Even if the OP signed the rego papers it wouldnt be considered proof of a transaction because rego doesnt prove ownership.

I guess none of you guy attend Court too often, to start with the prosecution has to prove the offence was committed not the other way around. So police would have to prove that the car was stolen based on evidence obtained, interviews of all parties and an investigation would be conducted into the circumstances of the stealing, ie where was the car parked when it was taken, what time was it taken, how did he obtain the keys, how do you know who stole the car, why did you wait so long before reporting it?? etc etc

Once all parties have been interviewed and everyone has provided their version the matter will never make it to Court as the car is not stolen it was traded for another car.

Should the OP lie during the investigation and change the story then he is committing perjury which carries a maximum prison term of 10 years under the NSW Crimes Act, and the people investigating the matter are not idiots they do this for a living, and they have a fair idea if someone is lying before they even open their mouth.

The original seller of the car has nothing to answer..

He will say he advised the buyer of the finance company interest in the vehicle.

Why else would he swap a BF XR6 for a AU XR6? The buyer agreed on those terms.

The buyer may not have understood this and thought he was getting the buy of the century. By not doing a check he may have accepted the car was encumbered. Just the payout was more than he thought.

I heard the whole story was a cover up.

Apparently the OP just had to have the XR6 as it was mint and way better than any FG he could find.
All was going well until it spat the rear main and dribbled lube all over the road in front of his neighbours house.
The neighbour noticed this and decided to cancel the BBQ he was putting on to introduce his single daughter to the OP, he wasnt going to have his daughter marry someone driving an old XR6 with a leaking main.

The OP, obviously embarrassed, then sold the XR6 to his mate for $1200 without disclosing the leaking seal.
The young lad is so ****ed, he put it all on Facebook and now none of the OP's mates will invite him over to talk cars during dinner.

I would own a dunnydore before owning a BA

AU's are one of the best falcons ever made!!!
