Default Shafted on car deal!!!!!....

Ok, this is going to sound so much dumber in writing but here goes...

My Best friend (adam) Got a $15,000 loan out to buy an already modded VH,
we found one in the quakka and went for a look, it was advertised for $13,000 or something but we were advised he would sell for $10,000 because the box was rooted, upon getting there the White VH had great rubbers, glass, panel and paint, all doors opened and shut like they were brand new,

the guy said kosteki ported the heads and that they cost him $5,000 complete.

the car was advertised as 320 v8 (offset ground crank?) with vn heads, trihard and 9inch, the engine was brand (2000km) new and the guy had told my friend it would be capable of 11 sec passes and his mate has the same combo and has run 11s before, when i saw the combo i could not see how it could make more then 400hp or do even low 12's (harrop duel plane, small hydralic, no stall ect) whats worse is that day we couldnt start it because the box was spewing oil all over the joint and we didnt want the box grabbing and damaging the engine.

i told my mate to look around and that i wouldnt pay more then $7,000 for it, we found an immaculate silver vh with a rebuilt 308 unregistered but didnt need much for $3000, i tried talking my mate into this one but he has a phobia with licensing cars.

later in the week the search was getting desperate and even other states only had nice VH's in the $10,000+ margin, my mate eneded up going around to the first VH's house, i wasnt there and they started the motor to hear it running anyway and my bestie said it sounded mad,

i went with adam to buy the vh, upon paying and getting it on the tilt tray IT DIDNT EVEN HAVE A 9INCH!!! this almost resulted in voilence but the seller apolagised "it was my mates car and he told me it had a 9inch, he has passed away now" he told us he couldnt lower the price but later on if we put a 9inch in it he would pay the cost,

trusting the guy Adam took the car and we got a tough trihard made for it, once the box was in and the car was running we needed to make massive tuning adjustments because the tune that was in it wouldnt have been good for 15's!!! got it running better (going down 10 jet sizes!!) and it is running flat 14's on street tires..ok... after checking things im starting to think the "ported $5000 heads" are just stock vn heads....the guy was moving house and said he has all the reciepts boxed up and we could get them later,

doing a cam change soon, so we are about to find out if these heads ARE kosteiki ported, if not someone is in alot of trouble as this was my friends buying point!

what can we do if the heads are stock in the way of the law?? i hope there is something for my mates sake!

All lessons are learnt through experience.For me to buy a modified car i would go over the car twice and make sure it had a 9inch before i paid the money!!!!!!!!!If that was my hard earned money and i got ripped off i would calmy ask him if he would like to meet the old owner of the car again or give me a refund.
Best thing to do is buy a standard one and do it bit by bit,it might be more expensive but atleast you know whats done.

Oh and finally never trust a Holden owner

It looks pretty schmick but in buying private you are generally out on your own, if you have it in writing that it has some of these things you may be able to persue fraud? but you'd need to see a lawyer to confirm something like that, if it was all verbal, sorry to say but you've probably cooked your goose

Is there any form of contract between the seller and your mate?, if not its just bad luck. The whole, it was my mates car story just sounds to dodgy to be true.

I would say unless it's all written down on paper on a sales contract or whatever you want to call it not a F*&* load legally can be done about it, it's possible that it may have had ported heads and a 9" at some point that had since been removed.

alarm bells would have been ringing upon realising the 9" was not there and you picking up on the combo not being able to make the power claimed by the seller would have been enough to question the hole car.

yes there is, we have his number, i didnt buy the dead mate story either...the 9inch bit was in the paper advertisement...

yes i did, there was no stopping my mate, we were told platinum series YT's but it only had street terras on a well, i suppose i have an ace up my sleeve though....im building the sellers next motor :P

defo VN heads, but why would you use a holley blue, no stall, no shift kit, hydralic cam, stock igintion and then pay $5000 on heads....if he spent $5000 on heads you would expect all the easy bolt on to be the best of the best

so did he end up paying for the diff? i find it strange that he wouldn't give you a discount but yet offers to pay for a new diff, i think your mate placed too much trust in this guy.

people strip cars when they sell them, maybe most of the good gear was taken off for the sale....

as for the missing 9" personally i would have backed the car off the tilt tray and got my money back before it went any further, If your mate was still keen on the car he should have looked it over better there and then..

So its just a verbal agreement?? or its written?

Regardless, i would take it back and advise him that you will require the cash back, it just all sounds wrong, i'd contact Kosteki's for some confirmation if they did the heads for the dead mate also.

I would say that your mate will spend at least another $10k on legal fees chasing what is a civil matter. At least he wont do it again.

Looks like a nice car in the pics but if it didnt have a 9inch it prob doesnt have the $5,000 heads

Selling a car for a dead mate, how does a mate trasnfer the car into some one else name if he is not the owner?

And the guy is moving.......... make sure you know where he is moving to - get his licence number, his rego number and any other form of id so you can go around and fix him up after you realise the $5,000 head story was a load of bull

And yeah take the car back and ask for your money back

I bought a xb coupe about 2 years ago, everything bar engine. Was told car was in immaculate condition inside with exception of one small stitching tear. The exterior was meant to be red pepper with only to minor dints on left hand rear quarter. Bought car and payed 1k deposit yet at this point had not seen the car as it was in sydney and i live in newcastle (2 and a bit hour drive). When i got there the interior was fadded and stitching in the seats was hand done as a patch up. Colour was burnt orange and was fadded and peeling. Car was not worth the money. Only being 16 at the time he told me i had to buy the car and there was no way that i would get my deposit back anyway. So i left at that point and went home. Spoke to a mates father whom was a lawyer and he said no chance of getting money back. So i went back down to see the guy whom was under the impression i was going to purchase the vehicle. However with about 10mins of quite intense negotiations (i may have been 16 but was 6ft2 100kg) he decided it was a good idea to give my money back and i went to the next suburb and bought a coupe in the same condition for $1500...

It can be easy to get caught up in all the excitement of buying a nice car. Smartest thing to do is take a mate that knows a bit about cars (even if the buyer knows a bit themselves) and get their opinion.
Sounds like your friend did that, just didn't listen to you.

it kinda sounded sus from the start and he went through with the deal anyway as he just wanted it.he's been had a bit i would think but it looks neat,hopefully the paint etc has all been done properly and he can build it to a tough car, all be one he may have paid too much for. you'd be hoping those heads are ported though but doesnt sound like they will be to me.

i would have gone home and thought about it after the diff discovery. he wont pay for the 9inch to go in. why would he?? got it in writing?

That was painful to read and got worse as I went along. Lets face it, alot of us have been there and done that. Hindsight is a wonderful thing and all the warning signs were there, some of us just choose to ignore them from time to time when we want something bad enough.

I once purchased a immaculate 1968 XR Ute V8 from local a car show. It was so well presented I stupidly believed everything the guy told me, handed over the cash & drove it home only to find out the car had almost no brakes, electrics were missing (not hidden..lol) and the motor sounded tuff, but in fact went like a old fart. You live and learn.

Worse still when you pay your hard earned money for engine upgrades/rebuilds and find out later you forked thousands of dollars when all they rebuilt was rings and bearings

Yes sorry mate but I think your mate has done his dough and would be surprised if that guy that sold the car is still around. Like what other people have said you live and learn. I think your mate might listen to your advice next time. It`s bull5h1t that scum that still try to rip people off of their hard earned!!!!

Theres only one commodore I'd have and its a VH I love em, always have however i wouldnt pay $13,000 for a VH unless, A: it was a Brock or B: EVERYTHING could be verified, even then if i were in ya mates shoes id have to have it running and driving 1st.

Not meaning to sound unsympathetic or anything but what did the guys mate die from?? Are you sure he didn't already try and sell the car to someone else, took their money and when they found out they'd been conned they sent the boys around to sort it out !!!! Seriously though, if your mate is considering trying to get a refund from this guy the first place I'd look would be the airport. /SARCASM\ :

10k sounds like a lot for a tidy vh with no receipts. There is prob little chance of getting any money back, with nothing in writing its just his word against your mates. A year ago 12k could have gotten your mate a twin turbo 355 vk - 11sec that a friend had
