Default License question.

Hi.

Last April I got done for no P plates, I was told to do a traffic ofendere program to keep my license, which I did yesterday, when I go back to court on the 25th and its all. Will I get to get my green P's ? I've done the test, passed and paid for it but was told I have to wait until court is over and done then go back and pick it up. Is this the case or do I have to still wait like another 6 months since the appeal thing has been going on?

Call the RTA Monday. You will get the correct answer.

You have a lot of problems with your licence buddy you must be a cop magnet. You post every 2 months about losing your licence and getting pulled over.

I've only ever been done once.... And if you look there all about the same thing... This has been draging on for nearly a year. And I have called the RTA they said I can get them, when I go to the RTA they say no..... Hence the thread for other peoples opinions.

Dont take our opinions, go to the RTA and tell them your frustration.

You want a letter or the info then and there.

Kinda slack you get grilled for no p plates, so feel for ya

Its stupid as it ended up in court and was adjourned almost a year 25th of this month. I won and kept my license because they found I was telling the truth and the police station was in fact closed, so now gotta wait til the 25th, so silly.

I thought no plates was just a slap on the wrist generally? worst case, 1 point and a couple hundred dollars.

I feel for ya, thats pretty lame. go vent at the RTA and tell them your getting mixed answers

Buddy92, Clerk of courts where you attended court should be able to advise you on your questions....that is what they are there for.

I got done for no P plates and speeding. Only 4 points the cop looked at me and said, what do you prefer. NO P plates or speeding fine. I took the P plate fine and was on my way home.

The courts keep in contact with the rego department, which the cops have access to in this area.....

So my suggestion....wait til the 25th and see what the man or woman on the bench says....until then, it's pure guess work on everyones behalf.....even a lawyers should you have one beside you on the day....if successful, the courts notify the rego department and will possibly give you a piece of paper saying you can have your green "p's".......

BTW make sure you have your proof of doing this course on you when you front the man/woman....

I would say the only reason it went to court is because the OP chose to take it to court, so it's no one else's fault it has gone to court.

Yup, as above, only reason a minor infringement like this would be in court. All seems a bit silly to me, unless there were other circumstances that we are unaware of.

Yeh great idea. I am thinking of taking up a discrimination action over being forced by law to have a different registration number on each or my cars and to have a different one to others.

We are all equal therefore we all have the right to have the same rego number if we choose or even to not have one at all. It serves no purpose as I can find my car in a car park.

For what other reason do I need a rego plate on a car?

Oh and speed limits, total discrimination. Why can't I do 130km/h past a school at pickup or drop off times if it is ok to do it in the middile of the Barkly.

It is just not right and like P plates serves no purpose at all other than to single me out and vilify me against others who have numbers plates and drive past schools slowly and carefully.

The only use I've ever seen for having p-plates is looking for hot girls in Mazda 2's.

Buddy, try and get as much info from the source. Even ask a few people from the RMS etc, because, like any industry, not everyone is great at what they do.

They usually only go to court if the fine/offence has been challenged.

I don't think that Mr Plod wants to spend his time in court arguing a P plate case.

Just reading back over this thread, Buddy92 what was the actual infringement for? I mean exact wording on the notice. Not displaying 'P' plates as in your original post or only displaying 1 plate as you stated later in the thread? If you were missing 1 plate, that can happen (fell off etc) and I know that you would normally be given a warning by the NSWP. Both plates missing is usually seen as calculating to deceive on your licence requirements unless you have a damn good excuse. I assume the court ordered/advised you to attend a traffic offenders program? It is a very harsh order from the beak if all is as you say it is!

At the end of the day this long drawn out process could have been avoided had you paid the original traffic ticket for what can only be decribed as a minor offence. I'm not knocking you for taking it to court because it is every persons right to have their day in court. I would have chosen to fight another battle though because you described that you had only one p plate displayed which unfortunately not complying with the p plate law. Did you deserve a ticket...probably not because at least you had one up.

I did pay the ticket, then had a letter saying my license was about go get suspended. The officer fined me because he thought I was lieing about the police station not being open 24 hour, ended up in court and realised I was telling the truth and was adjourned until the 25th of march.

yep any offence while on red p plates means possible loss of licence

The police station not being open 24h isn't an excuse for not displaying P plates, it is your duty to make sure you have replacement plates AT ALL TIMES (i always had at least 6 in my car just in case)

Sux to be without a licence though

Well to me having a huge stack of P plates isnt always a priority. You do run out unexpectedly, like bread and milk :P

And they said it was acceptable and if I complete the course ( I already did ) I get my points. But its been waiting a year sucks the most.
