Zero tolerance in Vic, although I beleive they may take 1 kmh off for radar tolerances

I know someone who is a police prosecutor, basically the one who agues for the police side in court, she said that there was the 3km tolerance on any speed limit, then 3km for camera error
but there is discretion involved with some cases |

Wear the Fine , But Learn from it aswell.. from my own experiance . i have found cruise control comes in very handy. but you have to watch for speed changes .

i know someone who got done allege speed 13kmph .. reduced to 10kmph for the 3kmph tolerance... though you may as well have 0% .. taking 3kmph off isn't going to lower the points that goes on your license eh.. (almost every other state? has the 10kmph tolerance because of factory speedo's MAY be inaccurate right?)

the whole inaccuracy of speedo from factory might have been right a few years ago, but these days the electronic speedo calibration is pretty damn spot on. i have found most factory cars with factory wheel size to be actually 1 - 2 km/h under on the spedometer compared to the dyno read out.
alteration of wheel size is the owners fault and should be adjusted or accounted for by the owner but i must admit i have been followed by police on several occasions doing 5 to 7km/h over my speedo and never had a hassle, only been booked when i crossed the 10+ marker, which is fair enough and that was my fault

your'e part right jc, i think thats applies when its raining though. i do feel for our mexican cousins though, me and the missus were down there a couple of weeks ago for a holiday, went down to geelong to look at the ford discovery centre. how many more speed cameras does "bracks" want to put on the overhead bridges on the freeway to geelong? there's heaps! still much better roads and traffic flow than here in sydney. to the ticket, i don't really think its worth fighting dude, it could end up costing you more in court costs etc than the actual fine.

I think you will find the 10% tolerence is as already stated a discretionary thing. Most cases I am aware of the descretion is more like lets say you get pulled up in a 60kph zone doing 77kph, you could argue yes I was speeding but I was only doing 74kph.
You could get the benifit of the doubt and get booked for the lesser charge of less than 15kph over the limit.

if people want to believe that they are allowed to travel 10% faster than the posted speed limit then they should cop it on the chin when they get done. a speed limit is exactly that. any faster and you are breaking the law and elligible for a fine. the cops with the camera's and the guns know exactly how fast you are going within about 1% so thats a risk you take if you don't want to believe what your speedo is telling you.
tolerances for speedo error is not a written law anywhere. most cars (every car from factory) speedo will actually read faster than you are going so to get done at 3 - 5kph over the limit your speedo was probably reading closer to 8kph over. the cops know this is the case as its illegal for a car manufacturer to have it out the other way. if you want to drive at 66 in 60 zones and 88 in 80's etc then don't be whinging when you get done. before you all jump down my throat, yes i speed from time to time and do other things that aren't exactly legal but thats my decision and i'll cop the consequence when it comes. touch wood, haven't been done speeding for over 10yrs so hopefully that continues. speed is a scapegoat for the govt and something that gets a lot of media attention so there will always be more cops attention on this than other offences. : |

And 100+ zones are a 3% tolerance. In WA however last time i checked was a 1% tolerance. But in saying that, your speedo will have a generous tolerance and combined with theirs you can get away with a bit. On holidays i passed a few cameras, two of them while i was overtaking on the highway and i expected at least 4-5 tickets when i got home..... still havent received nothing. And all these instances were doing around 110-115 in a 100 zone |

When I issue a speeding ticket in Victoria, I always have detected speed and then alleged speed being 2kmph less. This is the way I was taught. I don't know about other states. This is not the discretion. I understand the official Victoria Police line on discretion for members is 10kmph, but since then Bracks Tax has lessened the discretion from 10% to 3%. I am not sure if this affected Force Policy. I have my own level of discretion....
